Sales certificate The Sellers acknowledge they have a legal obligation to provide a ‘Certificate’ from the Local Government (howsoever called), because the building comprises “flats”. The Sellers agree to obtain the required certificate as well as comply at their own cost with any requisitions or requirements of the Local Government that issue prior to Settlement. The Sellers will provide the certificate to the Buyers at Settlement. (NOTES: The laws in most Council areas require Sellers of registered flats to obtain and provide a “Seller’s Certificate”. This clause makes the Sellers pay for all requisitions on the property, irrespective of their cost. This could be very tough on the Sellers if the building XE "building" is run down, but at the same time, the clause is designed to make sure that settlement happens on the due date.) |
