The Buyers acknowledge that the Property is currently tenanted. The Sellers will take all reasonable steps to arrange the tenants to move out of the Property by the Settlement Date. If the Sellers are not successful, the Buyers will not seek to cancel this Contract or seek compensation from the Sellers (or Agent) or attempt to delay settlement. (NOTES: Sometimes, for example with short settlements, the Seller can’t know whether they will be able to get tenants out fast enough for settlement. This clause is designed to prevent any delays to settlement. This clause is very much in favour of the Sellers - as it may leave the Buyers with tenants that they cannot get rid of. Also, the Buyers will not know until settlement itself whether they will be receiving vacant possession or not.) |

The Sellers agree that the property is sold with vacant possession. If the Sellers have not been able to remove the Tenants by ___/___/___ , then the Sellers can give notice to the Buyers extending Settlement Date by up to _ _ _ _ _ _ _ _ _ _ _ _ days. (NOTES: This clause gives an extended settlement, to allow time to get the Tenants out. This clause is much better for Buyers that the previous one. With this clause - the Buyers can be sure that they will be receiving vacant possession.) |
