Standard Fee
Our standard fee for
acting in the sale of a property, is:
$375.00 - subject to conditions*

Cancelled Contracts Our fees will be less if the contract is cancelled: |
Only $50.00 will be our TOTAL FEE (including GST) if the contract is cancelled by the Buyer on Building inspection, or Finance Approval, or similar condition.
$250.00 will be our fee if the contract is cancelled by either party more than 10 days before settlement.
Our full fee will apply if the contract is cancelled 10 or fewer days before settlement.

English Speaking We regret to advise that our firm is not multi-lingual, and we believe it is in breach of the guidelines and laws applying to lawyers (eg the "Conveyancing Protocol") to seek to obtain instructions from another person on behalf of a client without an interpreter. As we do not have these services available, we regretfully decline to act for non-English speaking clients. |

Higher Value Properties Additional fees will apply if the sale price is more than $1,500,000. For properties over this price our fees are as follows: |
$1.5m to $2.5m: standard conveyance fee is $ 675.00
$2.5m to $3.5m: standard conveyance fee is $1,275.00
$3.5m to $5m: standard conveyance fee is $2,200.00
over $5m our fees are on a "quotation only" basis.

Very Short Settlements A "very short" settlement, is one which occurs less than 9 days from the date we first receive instructions. |
$375.00 extra fees will be payable, if the settlement is less than nine days from the date we first receive instructions.

Short Settlements A "short" settlement, is one which occurs less than 15 days from the date we first receive instructions. |
$175.00 extra fees will be payable, if the settlement is less than 15 days from the date we first receive instructions.

Settlements out of Brisbane Settlements outside of Brisbane require special arrangements for lender to attend (to release) and special arrangements for other parties to attend. This incurs additional costs and additional time involved. |
$50.00 extra fees incurred: provided arrangements can be made for an agent to act unpaid at settlement.
$125.00 extra fees incurred - if an agent must be employed to travel to and attend settlement.

Commercial Property Additional fees will apply if the property is commercial ... for these properties our fees are as follows: |
up to $1.5m: standard conveyance fee is $675.00
$1.5m to $2.5m: standard conveyance fee is $ 1,275.00
$2.5m to $3.5m: standard conveyance fee is $2,200.00
$3.5m to $5m: standard conveyance fee is $3,600.00
over $5m our fees are on a "quotation only" basis.

Non-REIQ or Non-ADL contract If the contract is not in the form published by the REIQ, or by ADL, then our fees will be as follows: |
up to $1.5m: extra $ 300.00.
$1.5m to $2.5m: extra $900.00.
$2.5m to $3.5m: extra $1,200.00.
over $3.5m our fees are on a "quotation only" basis.

Partnership/Divorce Disputes Additional fees may apply if the sellers are divorcing ... for these sales our additional fees are: |
$zero ($nil) extra, if all instructions are jointly agreed (signed by both parties) with no disagreements or disputes.
$200.00 (flat fee) extra, where instructions must be separately obtained from two or more persons.
$50.00 per event ... where there is a discrepancy between sellers for instructions on an issue.
$50.00 per month ... where monies are retained in trust after settlement without being disbursed.
! NOTE - we will not at any time, under any circumstances, give any matrimonial advice !

Other Common Additional Work Additional work may include (but is not limited to): change of buyer’s names ($50.00), variation to contract price ($50.00), extension of time for deposit payment ($50.00 each), extension of time for special conditions ($50.00 each), extension of time for settlement ($50.00 each), agreement for early possession ($50.00), change of settlement place ($50.00), registration of power of attorney ($250.00), registration of record of death ($375.00), lost title deed ($1,100.00), re-attending settlement due to bank error ($50.00), settlement extension where bank not instructed by Clients ($150.00), discovering additional mortgages not disclosed by clients on the Appointment to Act ($65.00). |

Legal Advice Our fees cover: receiving the contract, arranging transfer papers, arranging settlement, arranging mortgage releases (if required), attendance at settlement, arranging deposits (if required) … but not including the optional “extras” listed on this page, or other matters, not strictly necessary to effect a transfer of title. A full description of what is included and what is not can be found here. If any additional advice is required, then the fees will be: |
$385.00 per hour (plus GST) for a lawyers time. This is charged per six minutes. So a 5 minute telephone call will cost $42.35.

Pre-Contract Negotiations As described under the sub-heading "Legal Advice", pre-contract negotiations are not included in the standard fee. Where negotiations are required before the contract is made, then |
$675.00 minimum - A minimum fee of $675.00 will be payable in relation to pre-contract negotiations, and this must be paid in advance of negotiations.
$385.00 per hour (plus GST) for a lawyers time. This is charged per six minutes. So a 5 minute telephone call will cost $42.35.
